About Our Consultation Process:

Every relationship for Estate and/or Elder Planning begins with our Confidential Estate Planning Questionnaire, which may be requested through this web site. The questionnaire is our roadmap for our planning discussion, and contains great detail to provide us with a framework. Rather than spending our time in a meeting inquiring which bank account is where, how many bonds someone may have, who are life insurance beneficiaries, or where the stock certificates are, we can focus on what our clients’ concerns and goals are. Without the completed questionnaire, the meeting could take most of the day and we risk everyone becoming tired, losing focus, and scheduling a follow-up meeting at an additional fee. To ensure we utilize our client’s time wisely, we specify that the completed questionnaire be returned to us in advance of our meeting. That way we have time to review it and decide what road to travel in our discussions with our client to make our meeting most effective, and so we can remind our client to bring any information that may have been overlooked. We also recommend our clients allow for about 2 to 2 and a half hours for our consultation meeting.

In the search for an attorney to prepare an estate plan, we are often asked what we charge to “draft a Will.” Our firm is comprised of licensed attorneys who practice estate, elder and tax law. Our relationship to our client is holistic in our obligation to be thorough and precise with the practice of law. We develop a written plan unique to our clients’ situations in accordance with statutes, regulations and case law that will serve as assurance that our clients’ wishes, needs, dignity and assets are protected to the best extent possible. Unless otherwise specified, every complete plan includes the Last Will & Testament, General Durable Power of Attorney and Advanced Healthcare Directive, beneficiary designation review and changes, asset transfers if recommended, as well as instruction on what to do with those documents to preserve them and use them when the need arises. If a form of trust is recommended, or a family partnership, LLC or business restructuring for more complex client issues is recommended, of course those documents are formulated and drafted as part of a plan, as well.

Our firm charges a reasonable consultation fee. Just as a doctor charges a consultation fee for a medical visit, the legal consultation is a forum for your attorney to review symptoms and recommend a course of treatment. We explain the law and demonstrate how the estate, trust and tax laws apply to our client’s specific circumstances. Typically, at the conclusion of an Estate Planning or Elder Planning meeting we are able to quote our clients a flat fee to prepare a plan, draft the plan, and educate the client on how to use the documents and deal with assets. If unexpected circumstances arise during the consultation that prevent us from quoting a flat fee, we’ll inform the client. Typically, however, our clients are very thorough in providing us information. For more complex or high-wealth individuals, reasonable fees may apply on an annual basis as necessary to maintain and administer the complex plan. Once retained, unless we otherwise specify, we require a 50% retainer fee for the work quoted, and the remainder is due upon our draft documents being delivered to the client. Payment plans are available in limited circumstances.

The estate and elder law consultation is an education. There are many misunderstandings and myths about what happens when an individual, spouse or parent becomes incapacitated, who has authority to act, and what may become of assets. It is our goal to help our clients and their families understand the thought process and importance of putting an appropriate plan in place so that when crisis happens, our clients have peace of mind. If the plan is not in place, or is an inadequate plan, we will suffer heartache, headache, loss of time and loss of money.

Partner Joseph A. Lambariello, practicing law since 1986 as a Juris Doctor graduate of Seton Hall Law School, earned an LL.M in Taxation in Law from New York University. Joe is admitted to both the New Jersey and New York bars. Joe provides his clients with a unique expertise in tax-related business and personal transactions such as business purchases, sales and mergers, 1031 like-kind exchanges, commercial real estate transactions, and representation and advocacy for clients before the Internal Revenue Service, New Jersey Division of Taxation, and tax courts. Tax laws also play a crucial role in Joe’s practice of complex estate planning, business and wealth succession planning, estate and trust administration, long-term care elder planning, and asset protection. Joe’s knowledge of the Internal Revenue Code is reflected in his artistic and compelling talent of unraveling complex tax, business and planning issues to offer our clients relief in the most delicate of financial matters. Joe counsels and establishes estate and tax planning for clients ranging from the mom and pop meat business to the multi-state transportation company.

Partner Stacey L. Pilato, admitted in New Jersey to practice law since 1999, provides a unique and caring perspective to this boutique practice. Bringing prior litigation and family law experience to the estate law and elder law arena, Stacey holds a Master of Science in Justice from The American University and is also a Juris Doctor graduate of Seton Hall Law School. Stacey began her concentration in estate and elder law when she first worked as Joe’s Associate Attorney beginning in 2005. As of April 2011, Stacey and Joe have been partners, complementing each other’s talents and insight to our varied clientele. Stacey is passionate about educating the public about the importance of having an appropriate and complete estate plan and often speaks to community groups about the risks of failing to plan or poor planning. For our elderly clients, Stacey assists with implementing a future care plan if a health crisis causes the necessity of care and assistance, and as an Accredited Veterans Benefits attorney, counsels our veterans and their survivors about the potential pension and aid available to supplement care, in addition to Medicaid planning. Stacey has a high standard of ethics, and she works diligently to meet her client’s needs in crisis situations.

Associate Amy J. Smith, admitted in New Jersey to practice law since 2010, and also a Juris Doctor graduate of Seton Hall Law School, primarily practices estate planning and estate administration, and she assists Joe with all aspects of his tax and business practice. Amy is a former law clerk who returned to the firm and the practice of estate, tax and elder law with a caring compassion that rounds out the firm’s personal connection to our clients, with whom we often develop life-long and generational relationships.

Associate Mary Kate Speed, admitted in New Jersey to practice law since 2014, completes our legal team. Mary Kate, as well, is a Juris Doctor graduate of Seton Hall Law School. Mary Kate’s practice primarily focuses on assisting our partners with estate planning and complex estate administration. Mary Kate’s estate administration practice is a combination of effectively communicating with financial institutions and the State of New Jersey for the preparation of estate and inheritance tax returns, and providing reassurance to our clients who are not only experiencing grief over the loss of a loved one, but are now also faced with the task of navigating tax and estate administration laws that may seem overwhelming.

Office Manager, Cristina (“Tina”) R. Griffith, has supported Joe as his Executive Assistant for over 23 years! Tina also serves as our office and staff manager, and she maintains our bookkeeping and billing. Essentially, Tina’s demanding daily role keeps us up and running.

Paralegal, Alicia Barone, a team member who began her career with us as a student in the paralegal Certificate program, Alicia was inducted into Lambda Epsilon Chi, the National Honor Society in Paralegal/Legal Assistant Studies at Middlesex County College.
